STB Extends Public Comment Period for Proposed CP-KCS Merger Draft EIS

In response to a request from “affected communities,” the Surface Transportation Board’s (STB) Office of Environmental Analysis (OEA) issued on Sept. 6 a notice extending the deadline for public comments on the Draft Environmental Impact Statement (EIS) for the proposed acquisition of Kansas City Southern (KCS) by Canadian Pacific (CP) to Oct. 14.

The STB’s OEA issued the Draft EIS on Aug. 5 and requested comments during a 45-day public comment period ending on Sept. 26. OEA stated it is issuing the notice to advise the public and all interested parties that the comment period will be extended but that “no further extensions of time will be granted” after the October due date.

According to the notice, after the close of the comment period, OEA will prepare a Final EIS that responds to all comments received on the Draft EIS and “sets forth OEA’s final recommendations regarding the potential environmental impacts of the proposed acquisition of KCS by CP, including OEA’s final recommended environmental mitigation measures.”

Comments on the Draft EIS may be submitted electronically on the Board-sponsored project website or the Board’s website by clicking on the “E-FILING” link.
